Description: 

In order to qualify for Opportunity Zone designation, a city or county must apply for designation of tax parcels that meet the following requirements:

  • All parcels requested for designation must be located in an area that is within or adjacent to census block groups with a poverty rate of 15 percent or greater as determined from data in the most current United States decennial census.
  • All parcels requested for designation must be located within the boundaries of an Enterprise Zone adopted by the local government pursuant to Chapter 88 of Title 36 OR located within the designated Urban Redevelopment Area of an Urban Redevelopment Plan that has been adopted pursuant to Chapter 61 of Title 36.
  • The parcels would also have to display visual blight and show signs of underdevelopment and general distress.  Underdevelopment would be demonstrated by high vacancy rates, low numbers of building permits issued, and low numbers of business licenses issued.  General distress would be demonstrated by high crime, code enforcement issuance, and unemployment rates.
